Submit the following items along with your application: cover letterresumereference listwriting sample This position acts as a Prosecutor I in Municipal Court and also provides a variety of legal services to the city as necessary or as directed by the Deputy City Attorney, City Attorney, or Chief Administrative Officer.
Responsibilities include performing prosecution casework, as well as drafting a wide variety of legal documents and correspondence.
The work performed by this class requires incumbents to apply professional knowledge and expertise as well as established guidelines and alternatives to determine facts, analyze problems, and make decisions without immediate supervisory review; incumbents may respond to sensitive and complicated inquiries or problems related to criminal and traffic prosecution.
The work requires judgment in selecting the appropriate methods and procedures for accomplishing project assignments, and incumbents perform their daily work independently and alert their supervisor to potentially controversial issues.
EXAMPLE OF DUTIES Other duties may be assigned as needed.
Serves as prosecuting attorney in criminal misdemeanor cases filed by the city; represents the city in bench and jury trials, pre-trials, arraignments, sentencing, traffic violations, and other misdemeanor and gross misdemeanor cases; represents the city in civil matters such as forfeitures, dangerous dog violations, code enforcement, nuisance, and other civil infractions.
Charges criminal cases; reviews and prepares documents and cases and reviews probable cause; attempts to resolve cases appropriately.
Tries cases to jury and bench, including preparation of jury instructions and preparation of motions related to cases.
Communicates with witnesses, police, other attorneys, and defendants as needed; communicates and coordinates with court administrative personnel, city departments, public defenders, and other personnel in matters related to criminal and traffic cases.
Participates in pre-trial conferences and in-court hearings to resolve cases prior to trial; negotiates, reviews cases, investigates, and makes offers; and attends sentencings.
Organizes case information and analyzes pertinent case facts and evidence; researches legal precedent and develops arguments as appropriate; prepares legal documents required to proceed with criminal cases.
Analyzes and evaluates the validity of each criminal charge; performs a variety of case preparation duties such as reviewing and signing citations and long form complaints, plea bargaining, negotiating and interviewing witnesses.
Represents the city in court on contested hearings and other infractions as required.
Performs appellate work as needed; researches and prepares briefings and presents oral arguments in court hearings as required.
Performs legal research and prepares opinions and training documents related to various legal issues; prepares and drafts ordinances, and other legal documents and instruments.

This position is usually assigned to an office, and the noise level in the work environment is usually low to moderate.
Work is performed mainly during City office hours; however, incumbent may occasionally be required to participate in evening court proceedings or attend night meetings of the City Council.
